Terms of Service

By creating an account or using BannerKit AI (“the Service”, “we”, “us”), you agree to these Terms of Service. If you do not agree, do not use the Service.

You sign in via email magic link. You are responsible for keeping access to your inbox secure and for activity that occurs under your account. You must be at least 13 years old to use the Service, or the minimum age at which a person may consent to data processing in your jurisdiction.

One credit generates one banner of any supported size. Credit packs are sold as one-time purchases, processed by Stripe. Credits do not expire while your account is active.

Refunds for unused credits are available within 14 days of purchase by request. Credits already spent on generated banners are non-refundable. If a render fails due to a Service-side error, the credit is automatically refunded to your balance.

Crypto checkouts (where offered) are final once the transaction confirms on chain.

You retain rights to the prompts and source URLs you submit, and to the banners produced for you, subject to the licenses of the underlying AI models we use (currently Google Gemini). You grant us a limited license to store, transmit, and display your generated banners for the purpose of operating the Service.

You are responsible for the content you generate. You may not use the Service to create content that infringes third-party rights, depicts illegal activity, contains hateful, sexual, or harassing material targeting individuals or groups, or that misrepresents real people or brands without authorization.

We may feature your generated banners on our marketing pages unless you opt out by contacting support.

We host completed banners on a CDN at non-expiring URLs while your account is active. We do not guarantee uptime, and we may migrate, throttle, or remove banners that consume disproportionate bandwidth, contain prohibited content, or that are part of a closed account.

You agree not to:

• abuse, reverse engineer, or attempt to circumvent rate limits or anti-fraud measures;
• use the Service to send spam, malware, or unsolicited advertising;
• resell credits or impersonate another person;
• violate applicable laws, including export controls and sanctions.

We may suspend or terminate accounts that violate these Terms or that present a fraud or abuse risk. You may close your account at any time; on closure, hosted banners may be removed and unused credits forfeited unless you request a refund within the 14-day window above.

The Service is provided “as is” without warranties of any kind. We do not warrant that generated banners are fit for a particular purpose, free of errors, or compliant with any specific ad network’s policies. You are responsible for reviewing banners before using them in paid campaigns.

To the fullest extent permitted by law, our aggregate liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

We may update these Terms. Material changes will be announced on this page with a new “Last updated” date. Continued use after changes take effect constitutes acceptance.
